Terms of Service

This update removes platform age and guardian-consent activation restrictions. Organization authorization and data protection requirements remain unchanged.

1. The service and the agreement

These Terms govern access to A-PATH at a-path.com, operated by GMP Global Marketing Inc., a California, United States company. A-PATH helps organizations manage coaching, athletes, classes, progress, ratings, badges, and authorized member access. Our Privacy Policy explains how we handle personal information; it is not a blanket consent to all data uses.

The published Terms must be made available before account acceptance. By completing the applicable acceptance process, you agree to the Terms for the account you are authorized to use. Publishing these Terms does not by itself establish that every existing user has accepted them or activate a future feature. If you do not agree to the applicable published Terms, do not create or continue to use an account.

2. Eligibility and organization authorization

A-PATH does not impose a platform age threshold or require a guardian-consent process to activate an account. Existing identity verification and authorization procedures still apply to accounts and organization access.

You must be authorized to act for an organization to establish it or exercise its coaching or administrative permissions. Membership alone does not confer coaching, administrative, scoring, or badge-awarding authority. Google sign-in and email verification do not replace organization authorization.

3. Accounts and organization membership

Provide accurate information, protect your credentials, and use only accounts and login methods you are entitled to control. Notify us promptly if you suspect compromise. We may require reasonable verification for recovery or changes to security methods.

Coaches may establish an organization or join an existing organization by invitation. Members may accept an invitation or apply to join an organization, including through its QR code or link. Registration alone does not guarantee membership or access to any athlete. The organization must grant the appropriate access.

A member is not automatically a parent, guardian, athlete, or owner of a record. A claimed relationship does not establish legal authority or access rights. Each person must use their own authorized account. A shared email address, Google identity, or phone number does not entitle someone to take over or merge another person's account.

4. Organization responsibilities and permissions

Organizations are responsible for their staff, membership decisions, athlete assignments, access grants, coaching content, and the authority to enter or disclose information. They must give appropriate notices and obtain permissions required for athlete records, especially records about minors. A-PATH's own legal responsibilities are not transferred to the organization by this clause.

Members may review only the athletes, classes, scores, and badges made available by the organization. Authorized coaches and trainers may score or award badges only within their assigned scope. Changing a person's title, account label, or guardian relationship does not expand these permissions.

Shared notes may be visible to other authorized people for the same athlete. Do not use them as a private or emergency communication channel. Review recipients and permissions before sharing a report outside the platform.

5. Your content and our limited permission to use it

You and the appropriate rights holders retain ownership of content submitted to A-PATH. You grant GMP Global Marketing Inc. the limited permission needed to host, process, display, transmit, and maintain that content to deliver the service to authorized users, provide support, maintain legitimate recovery copies, and comply with law. This permission does not authorize sale of athlete information or unrelated advertising use.

You must have the rights and authority needed to submit content, including information about another person or an external video link. Do not submit unlawful, infringing, exploitative, or unnecessarily sensitive content. Rights of individuals under applicable privacy law continue to apply regardless of who owns a document or coaching record.

We may restrict access to content where reasonably necessary to address an apparent violation, protect someone, or comply with law. We do not promise to review all content before it is stored or displayed. Contact us to report a rights or safety concern.

6. Acceptable use

  • Use the service only for lawful, authorized coaching and membership purposes.
  • Do not bypass permissions, test another person's account, exploit a vulnerability, or access records without authorization. Report suspected vulnerabilities privately to info@a-path.com.
  • Do not harass, threaten, exploit, discriminate unlawfully, or submit sexual content involving minors.
  • Do not submit malware, spam, false invitations, or abusive automated requests; interfere with the service; or collect users' information without authority.
  • Do not share passwords, verification codes, or private invitations, or use another person's phone or Google account to impersonate them.
  • Do not misrepresent badges, ratings, or reports as independent medical advice, regulated qualifications, or a guarantee of sporting results.

7. Coaching decisions, scores, and safety

Coaching is provided by the relevant organization and its personnel. They are responsible for their instruction, supervision, scheduling decisions, and the accuracy of records they enter. A-PATH is a management tool and does not independently certify every coach or validate every assessment.

Athlete, sport, and badge levels use Level 1–10. Individual skill scores use a separate 0–5 scale. A badge is a record of an authorized award, not a guarantee of competence, safety, admission, or results. An authorized higher-level award may raise the recorded athlete level without automatically issuing every intervening badge.

Sports involve physical risks. Seek appropriate professional advice and supervision, and contact emergency services for emergencies. A-PATH is not a medical service, emergency service, or substitute for appropriate coaching judgment. These Terms do not waive liability or rights that applicable law does not allow to be waived.

8. Fees, availability, and third-party services

A-PATH offers system subscriptions through Stripe-hosted checkout. Review the selected plan, currency, billing period, final charge and renewal details before authorizing payment. Subscription access follows verified billing records. Merely viewing a plan or accepting these Terms does not authorize a charge.

Use the available billing-management page or contact info@a-path.com for subscription, cancellation or refund assistance. Coaching fees, booking terms, cancellations and refunds agreed with an organization are that organization's arrangements, subject to applicable law. Sample prices in design documents do not override the actual checkout.

Google sign-in is optional when offered and is also subject to Google's applicable terms. SMS through Twilio is not yet active. Provider outages or changes may affect a login method; retain an available recovery method. Using or revoking a third-party connection does not automatically delete A-PATH organization records.

Authorized staff can add up to 10 photos and 3 uploaded videos to each athlete library, subject to the displayed file and access limits. You must have the rights and permissions needed to upload and share those files with the organization-authorized viewers. Uploaded files are separate from lesson drafts. Native iOS and Android applications and offline synchronization are not currently offered by this Web release; a responsive website does not constitute a released native app.

9. Suspension, ending use, and records

You may stop using the service and contact us about account closure or data requests. An organization may end or suspend membership within its authority. We may reasonably restrict an account or service to address abuse, unauthorized access, a serious security issue, a violation of the Terms, or a legal requirement. Where appropriate and legally permitted, we will explain the reason and provide a way to contact us about the decision.

A change to an account does not automatically decide who may access the underlying athlete record; that requires a separate authority and permission review.

Ending access does not automatically erase coaching records, valid obligations, security records, or recovery copies. Requests are handled under the Privacy Policy and applicable law. We do not promise uninterrupted availability or an automatic rollback that discards other users' new information. Arrange any necessary authorized export with your organization before access ends where practicable.

10. Intellectual property

A-PATH's software, design, branding, and other platform materials belong to GMP Global Marketing Inc. or the relevant licensors. You may use them as necessary for authorized use of the service. Do not copy, resell, misrepresent ownership of, or use our marks to imply endorsement without permission, except where law or an applicable license permits it. Third-party trademarks and licensed fonts remain subject to their owners' rights and licenses.

11. Service limitations and responsibility

We use reasonable care to operate the service but cannot promise that it will always be uninterrupted, error-free, or suitable for every purpose. To the extent permitted by applicable law, the service is provided as available, without additional implied warranties. This does not exclude any mandatory consumer guarantees.

To the extent permitted by applicable law, GMP Global Marketing Inc. is not responsible for indirect or consequential losses arising from use of the service. This does not exclude or limit liability for fraud, willful misconduct, gross negligence, injury, privacy violations, or any other liability to the extent the law does not permit that exclusion or limitation. These Terms do not impose a fixed monetary liability cap, mandatory arbitration, or a class-action waiver.

12. Applicable law, changes, and contact

California law and applicable United States federal law govern these Terms, without displacing mandatory protections available under the law applicable to you. No exclusive distant forum or private arbitration requirement is imposed by this version. You may contact us to seek an informal resolution without losing any right to approach a regulator or a court with jurisdiction.

The effective date and version appear at the top of these Terms. Material changes require appropriate advance notice and any renewed acceptance required by law. Changes will not retroactively authorize an undisclosed charge or remove a non-waivable right. If a provision cannot be enforced, the remaining provisions continue to the extent permitted by law. A separate signed agreement may govern an organization's additional service arrangements, without reducing individuals' mandatory rights.

English and Traditional Chinese versions are provided for accessibility. Contact us if you find a material difference; no translation clause overrides a mandatory right to receive or rely on information in a particular language.
